Virginia is appealing its lawsuit against the federal health care law to the U.S. Supreme Court. Last month, a Richmond U.S. Circuit Court ruled against the Commonwealth, saying it lacked the legal standing to pursue its case. Cuccinnelli's office filed the appeal on Friday, arguing state law gives Virginia the power to challenge the federal law's provision that will require individuals to have health insurance or pay a penalty. The Supreme Court could rule on the constitutionality of the health care overhaul as early as next summer, just before the presidential election.
