A Judge earlier this month ruled in favor of Amherst County, and now the Phelps Road school is officially slated for the auction block. The former Madison Heights Elementary School opened in the 1930s, but closed more than 20 years ago. In June 2013, county building officials condemned the structure. County officials requested auction of the building and its property for delinquent taxes in excess of two years. The judge has not granted a request to demolish the structure while an appeal to the demolition is pending. In December, an apparent arson attempt occurred in the hallway of the school.
